1. Introduction
These WhatsApp Business Terms of Service ("Terms") govern your use of WhatsApp messaging services operated by
Justauto Solutions Private Limited ("JustAuto", "Company", "We", "Us", or "Our"), having its registered office at B-1, B-2, B-3/15, Electronic Estate, GIDC, Sector 25, Gandhinagar, Gujarat, India.
We use WhatsApp Business Platform / WhatsApp Business API (via Meta Platforms, Inc. and authorised solution providers) to communicate with customers, prospects, students, and business partners in connection with our automobile training courses, diagnostic products, franchise opportunities, and related services offered through
www.justautoindia.com.
By initiating a conversation with us on WhatsApp, responding to our messages, clicking a Click-to-WhatsApp advertisement, scanning a QR code, or otherwise contacting our official WhatsApp Business number(s), you acknowledge that you have read, understood, and agree to these Terms and our
WhatsApp Privacy Policy.
2. Acceptance of Terms
If you do not agree to these Terms, please do not message us on WhatsApp or use our WhatsApp Business services. Continued use of our WhatsApp channel after any update to these Terms constitutes acceptance of the revised Terms. We may update these Terms from time to time; the "Last Updated" date at the bottom of this page will reflect the latest revision.
3. Nature of WhatsApp Communication
Our WhatsApp Business channel is used for legitimate business communication, including but not limited to:
- Responding to customer and prospect enquiries received through Click-to-WhatsApp ads, Google Ads and other Google advertising services, other social media platform campaigns, website widgets, or direct messages
- Sharing information about training courses, fees, schedules, products, franchise opportunities, and related offerings
- Sending appointment confirmations, follow-ups, reminders, and service-related updates
- Sending Meta-approved WhatsApp message templates for transactional, service, or marketing purposes where permitted
- Customer support and relationship management within applicable messaging windows
WhatsApp is a third-party messaging platform owned by Meta Platforms, Inc. Your use of WhatsApp is also subject to Meta's and WhatsApp's own terms of service and privacy policies. JustAuto is not responsible for WhatsApp's platform availability, features, or policies.
4. Consent to Communicate
By messaging our WhatsApp Business number, submitting your phone number through a form, advertisement, or lead channel that redirects to WhatsApp, or expressly requesting us to contact you on WhatsApp, you provide your consent for JustAuto to:
- Receive and process your WhatsApp messages
- Capture and store your WhatsApp profile name (as displayed), phone number, and message content in our internal business panel / CRM for enquiry handling
- Reply to you within the WhatsApp customer care window (typically 24 hours from your last message, as defined by Meta/WhatsApp policies)
- Send you WhatsApp Business message templates that have been submitted to and approved by Meta/WhatsApp, where template messaging is used outside or in addition to the customer care window
You confirm that the mobile number you use is owned or lawfully controlled by you, and that you are authorised to receive business communications on that number.
5. Message Templates and 24-Hour Messaging Window
5.1 Customer Care / Service Window
When you send us a message, Meta/WhatsApp generally provides a customer care window (commonly 24 hours) during which we may reply with free-form messages related to your enquiry or ongoing conversation.
5.2 Template Messages
Outside the customer care window, or for proactive business outreach where permitted, we may send only Meta-approved message templates. Templates may include utility, authentication, or marketing category messages as classified by Meta, and will be used in accordance with WhatsApp Business Messaging Policies.
5.3 Frequency and Relevance
We strive to send only relevant, non-spam communications. Marketing templates will be sent only where we have a lawful basis and appropriate consent under applicable Indian law and Meta policies. You may opt out of marketing messages at any time as described below.
6. Opt-Out and Preference Management
You may stop receiving marketing or promotional WhatsApp messages from us at any time by:
- Replying with "STOP", "UNSUBSCRIBE", or "OPT OUT"
- Requesting our team in writing to remove your number from promotional messaging lists
- Emailing us at justautoindia@gmail.com
After opt-out, we will stop sending promotional/marketing template messages. We may still contact you for essential transactional or service-related communications where legally permitted or where you initiate a new conversation. Blocking our number on WhatsApp will also stop further messages from that chat.
7. User Obligations and Prohibited Conduct
You agree not to use our WhatsApp channel to:
- Send abusive, defamatory, obscene, threatening, or unlawful content
- Share malware, phishing links, or attempt unauthorised access to our systems
- Impersonate another person or provide false contact details
- Harass our staff or misuse the channel for spam or commercial solicitation unrelated to our services
We reserve the right to discontinue conversation, block numbers, and take appropriate action where prohibited conduct is identified.
8. Accuracy of Information
Information shared over WhatsApp (including course details, fees, schedules, product descriptions, and offers) is for general guidance. While we endeavour to keep information accurate, final confirmations, commercial terms, and formal agreements remain subject to our official website, written quotations, invoices, and applicable company policies. In case of conflict, written commercial documents issued by JustAuto shall prevail.
9. No Guarantee of Instant Response
We aim to respond during business hours on a best-effort basis. WhatsApp messaging does not create an obligation of immediate reply, continuous availability, or emergency support. Response times may vary based on enquiry volume, holidays, and operational capacity.
10. Intellectual Property
All content shared by JustAuto over WhatsApp - including course materials summaries, brochures, images, logos, videos, and documents - remains the intellectual property of JustAuto or its licensors. You may not copy, redistribute, or commercially exploit such content without prior written consent.
11. Limitation of Liability
To the maximum extent permitted by law, JustAuto shall not be liable for any indirect, incidental, consequential, or special damages arising from WhatsApp communication, including but not limited to message delivery failures, delayed responses, third-party platform outages, unauthorised access to your WhatsApp account, or reliance on informal chat advice without formal confirmation. Nothing in these Terms excludes liability that cannot be excluded under applicable Indian law.
12. Privacy and Data Protection
Collection and processing of personal data through WhatsApp is described in our
WhatsApp Privacy Policy. By using our WhatsApp services, you also acknowledge that Meta/WhatsApp may process message metadata and content according to their own policies.
13. Compliance with Laws and Meta Policies
We operate our WhatsApp Business account in good faith compliance with:
- Applicable laws of India, including the Information Technology Act, 2000 and rules thereunder
- WhatsApp Business Terms, WhatsApp Business Messaging Policy, and Meta Commerce / advertising policies
- Requirements relating to consent, opt-out, template usage, and prohibited content categories
We do not use WhatsApp for unlawful, deceptive, or prohibited categories of content as defined by Meta.
14. Relationship with Website Terms
These WhatsApp Terms apply specifically to WhatsApp Business communications. They are in addition to our general website
Terms & Conditions. Where a conflict arises specifically relating to WhatsApp messaging, these WhatsApp Terms shall prevail for that subject matter.
15. Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of India. Subject to applicable law, courts at Ahmedabad, Gujarat, India shall have exclusive jurisdiction over disputes arising out of or in connection with these Terms.
